01 — The agreement

By chartering an aircraft from Aerion Charter Co. ("Aerion", "we", "us") you ("you", "the charterer") agree to these Terms of Service. Together with our Privacy Policy, our Cookie Policy, and the operating manual for your specific aircraft, they form the entire agreement between us.

02 — Booking & confirmation

A booking is confirmed only when you receive a written confirmation from Aerion dispatch (email or printed itinerary). A request alone does not constitute a confirmed booking. We reserve the right to refuse a booking for any reason consistent with FAA regulations and our internal safety policy.

Identification

All passengers, including children and infants, must present valid government-issued identification at the hangar prior to boarding.

03 — Payment

Charters are quoted in U.S. dollars. A 30% deposit is required to confirm a booking; the remainder is due 24 hours before the scheduled departure. Payments are processed by Stripe under their terms.

The Pilot in Command has absolute and final authority on whether a flight may proceed. We will not fly when, in the captain's judgement, conditions are unsafe. In such cases we will rebook, refund, or arrange ground transportation at no additional cost. Weather delays of less than 6 hours are not considered cancellations.

06 — Conduct on board

You agree to follow all crew instructions. We do not permit smoking of any kind, illegal substances, firearms (outside lawful sealed transport), or intoxication that compromises safety. The captain may divert or terminate a flight in response to unsafe behavior; no refund is owed in such cases.

07 — Liability

Aerion holds $300,000,000 in passenger liability coverage per occurrence. Our total liability for any single incident is limited to actual demonstrable losses. We are not liable for indirect, consequential, or punitive damages, including missed onward connections, loss of business opportunity, or speculative damages.

Force majeure

We are not liable for delays or cancellations caused by acts of God, government action, airspace closure, labor stoppage, or other events beyond our reasonable control.

08 — Disputes

Any dispute will first be addressed by good-faith conversation with our Director of Customer Care. If unresolved within 60 days, disputes will be settled by binding arbitration administered by the American Arbitration Association in New York County, under New York law. You waive the right to a jury trial and to participate in a class action.

09 — Changes

We may revise these Terms. Material changes are emailed to active members 30 days before they take effect. Continued use after the effective date constitutes acceptance.
